Introduction
This Privacy Policy describes how Biofusion Tech LLC and its corporate affiliates (collectively, “Biofusion,” “we,” “us,” or “our”) process personal information that we collect or generate through our websites (including biofusion.co), platforms, applications, and social media pages that link to this Privacy Policy, as well as our marketing activities, events, and other activities described below (collectively, the “Service”). Biofusion distributes healthcare products and provides technology to clinics and other healthcare organizations.
Biofusion may process personal information that identifies your past, present, or future physical or mental health status, or that otherwise constitutes “consumer health data” or an equivalent term under applicable U.S. state laws (“Consumer Health Data”). To the extent those laws apply to your Consumer Health Data, our Consumer Health Data Privacy Policy supplements this Privacy Policy.
What this Privacy Policy does not cover. This Privacy Policy does not apply to “protected health information” (“PHI”) that we receive from, create, or process on behalf of “covered entities,” as those terms are defined by the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), such as the clinics, hospitals, and other healthcare providers we serve. Our use of PHI is governed by HIPAA and by our business associate agreements with those covered entities. If you have questions about PHI we process on behalf of a clinic or other healthcare provider, please contact that provider directly. If you have signed an authorization allowing a covered entity to disclose your information to Biofusion for our own purposes, this Privacy Policy applies to that information.
Personal information we collect
Information you provide to us or that we generate about you. Depending on how you interact with the Service, this may include:
- Contact data, such as your first and last name, email address, billing and shipping addresses, and phone number.
- Professional data, such as the clinic or organization you work for, your job title, professional license or NPI number, and business contact details, when you purchase or use our products on behalf of a clinic.
- Demographic data, such as your city, state, postal code, age, date of birth, and gender.
- Account data, such as the username and password you set to create an account on the Service, your preferences, and other information you add to your account profile.
- Self-reported health data, such as information you choose to provide in questionnaires, surveys, intake forms, or other forms on the Service about your physical or mental health, conditions, medications, or lifestyle.
- Transactional data, such as information needed to complete your orders, including products purchased, order numbers, and transaction history.
- Payment data needed to complete transactions. Payments are collected and processed directly by our third-party payment processor, Whop, as described below.
- Communications data based on our exchanges with you, including when you contact us by email, phone, social media, or otherwise.
- Marketing data, such as your preferences for receiving our marketing communications and details about your engagement with them.
- Testimonial data, such as feedback, reviews, quotes, photos, or videos you provide for use in a testimonial.
- Derived data, such as inferences we draw from your personal information.
- Other data not specifically listed here, which we will use as described in this Privacy Policy or as disclosed at the time of collection.
Third-party sources. We may combine personal information we receive from you with personal information we obtain from other sources, such as:
- Public sources, such as government agencies, public records, professional licensing databases, and social media platforms.
- Clinic and healthcare partners, such as clinics, healthcare providers, and other organizations that purchase or use our products and technology.
- Marketing partners, such as joint marketing partners and advertising platforms.
- Service providers that perform services on our behalf or help us operate the Service or our business.
- Business transaction partners, such as an entity we acquire or are acquired by, a successor, or any party involved in a merger, acquisition, sale of assets, or similar transaction, or in an insolvency, bankruptcy, or receivership.
Automatic data collection. We, our service providers, and our advertising partners may automatically log information about you, your device, and your interactions over time with the Service and our communications, such as:
- Device data, such as your operating system and version, device manufacturer and model, browser type, screen resolution, device type, IP address, unique identifiers (including advertising identifiers), language settings, mobile carrier, network information, and general location such as city, state, or region.
- Online activity data, such as pages or screens you viewed, how long you spent on them, the website you visited before the Service, navigation paths, access times and duration, and whether you opened our emails or clicked links in them.
- Communication interaction data, such as whether you open or forward our emails, which we may detect using pixel tags embedded in our messages.
Tracking technologies. This automatic collection is facilitated by:
- Cookies, small text files that websites store on your device to remember your preferences, login status, and browsing activity. We use session and persistent cookies, including first-party cookies we place and third-party cookies placed by our service providers and advertising partners.
- Local storage technologies, such as HTML5, which provide cookie-like functionality and can store larger amounts of data on your device.
- Pixels and web beacons, also known as pixel tags or clear GIFs, including advertising pixels provided by Meta and Google, which show that a webpage or email was accessed or that certain content was viewed or clicked.
How we use your personal information
We may use your personal information for the following purposes, or as otherwise described at the time of collection.
Service delivery and operations. We may use your personal information to:
- provide, operate, and improve the Service and our business;
- process and fulfill your orders, shipments, and transactions;
- provide our technology to clinics and other healthcare organizations;
- establish and maintain your account;
- enable security features, such as sending security codes and remembering devices you have logged in from;
- communicate with you about the Service, including announcements, updates, security alerts, and support and administrative messages;
- personalize your experience with the Service and our communications; and
- respond to your requests, questions, and feedback.
Insights and development. We may use your personal information to analyze use of the Service, understand how users interact with it and with our emails, conduct research, and develop new products and services.
Marketing and advertising. We, our service providers, and our advertising partners may use certain personal information for marketing and advertising:
- Direct marketing. We may send you marketing communications about our products and services and personalize them based on your interests. You may opt out as described in the Opt out of communications section below.
- Interest-based advertising. Our advertising partners, including Meta and Google, may use cookies, pixels, and similar technologies to collect information about your interactions with the Service and other online services over time, and use it to show you ads they think will interest you. We may also share information with these partners to help reach you or similar audiences on other platforms. We do not use health information for interest-based advertising. - Testimonials. With your consent, we may publish your feedback or testimonial on our website and in our marketing materials.
- Events and promotions. We may use your personal information to administer promotions, communicate with you about events you attend, or contact you after collecting your information at an event.
Cookies and similar technologies. We use tracking technologies for:
- Technical operation, such as remembering selections as you navigate and whether you are logged in.
- Functionality, to enhance the performance of the Service.
- Advertising, to measure the effectiveness of our ads and to support interest-based advertising as described above.
Use of artificial intelligence. We may use artificial intelligence and machine learning tools, including tools offered by our service providers, to help operate, support, and improve the Service. When we do, we use personal information only for the purposes described in this Privacy Policy.
Compliance and protection. We may use your personal information to:
- comply with applicable laws, lawful requests, and legal process, such as subpoenas, court orders, or requests from government authorities;
- protect our, your, or others’ rights, privacy, health, safety, or property, including by making and defending legal claims;
- audit our internal processes for compliance with legal and contractual requirements and our internal policies;
- enforce the terms and conditions that govern the Service; and
- prevent, identify, investigate, and deter fraudulent, harmful, unauthorized, unethical, or illegal activity, including cyberattacks and identity theft.
Corporate events. We may use and share personal information in connection with actual or prospective corporate events, as described in How we share your personal information.
With your consent. In some cases, we may ask for your consent to collect, use, or share your personal information, such as when required by law.
Aggregated and de-identified data. We may create aggregated, de-identified, or anonymized data from your personal information by removing information that identifies you. Except as required or permitted by law, we will not attempt to re-identify such data. We may use and share it for lawful business purposes, including to analyze and improve the Service, develop and train machine learning models, promote our business, and conduct research.
How we share your personal information
We may share your personal information with the following parties, and as otherwise described in this Privacy Policy or at the time of collection.
- Affiliates, such as any corporate parent, subsidiaries, and affiliates of Biofusion.
- Service providers that perform services on our behalf or help us operate the Service or our business, such as hosting, information technology, order fulfillment and shipping, customer support, email delivery, and marketing.
- Artificial intelligence providers that offer AI-enabled tools we use to operate and improve the Service. We require these providers to use personal information only to provide services to us.
- Payment processors. Payments made through the Service are collected and processed directly by our payment processor, Whop, which may use your payment data in accordance with its own privacy policy.
- Advertising partners, such as Meta and Google, for the interest-based advertising purposes described above. We do not provide health information to advertising partners.
- Clinic and healthcare partners, such as the clinics, healthcare providers, and organizations that purchase or use our products and technology, where needed to provide the Service.
- Third parties designated by you, where you have instructed us or consented to share your personal information.
- Business and marketing partners with whom we jointly offer products or services, or whose products or services may interest you.
- Professional advisors, such as lawyers, auditors, bankers, and insurers, where necessary for the professional services they provide to us.
- Authorities and others, such as law enforcement, government authorities, and private parties, where we believe in good faith it is necessary or appropriate for the compliance and protection purposes described above.
- Business transferees and their advisors, in connection with actual or prospective business transactions, such as investments in or financings of Biofusion, or the sale, transfer, or merger of all or part of our business, assets, or ownership interests, including in an insolvency, bankruptcy, or receivership.
- The public. If you provide a testimonial and consent to its publication, it may be visible to the public. Published content can be viewed, copied, cached, or stored by others, including search engines, and we are not responsible for such use.
Your choices
Access or update your information. If you have an account, you may review and update certain account information by logging in and visiting your account settings.
Opt out of communications. You may opt out of marketing emails by following the unsubscribe instructions in the email or by contacting us at admin@biofusion.co. It may take some time for your opt-out to take effect. You may still receive service-related and other non-marketing messages. If you receive text messages from us, you may opt out by replying STOP.
Cookies. Most browsers let you remove or reject cookies through their settings. If you disable cookies, the Service may not work properly. Learn more at allaboutcookies.org.
Blocking images and pixels. Most browsers and devices let you prevent images from loading, so the sender cannot detect that you viewed a page or email.
Do Not Track and Global Privacy Control. We do not currently respond to “Do Not Track” browser signals. Where required by applicable law, we treat Global Privacy Control signals as a valid request to opt out of targeted advertising and the sale or sharing of personal information for that browser.
Advertising choices. You may be able to limit the use of your information for interest-based advertising by:
- Browser settings: blocking third-party cookies.
- Privacy browsers and plug-ins: using browsers or ad-blocking plug-ins that block tracking technologies.
- Platform settings: using the ad preferences offered by Google and Meta.
- Ad industry tools: using the opt-out programs of the Network Advertising Initiative, the Digital Advertising Alliance, and the DAA’s AppChoices mobile app.
- Mobile settings: limiting use of your device’s advertising ID.
You must apply these settings on each device and browser you use. We cannot guarantee that the companies we work with participate in these opt-out programs.
Shine the Light. Under California Civil Code Section 1798.83, California residents may opt out of our disclosure of their personal information to third parties for those third parties’ direct marketing purposes. Email admin@biofusion.co with the statement “Shine the Light Request,” your first and last name, your mailing address, and a certification that you are a California resident. We may request additional information to verify your identity and residency.
Declining to provide information. Some services require personal information. If you do not provide required information, we may not be able to provide those services.
Your state privacy rights
Depending on the U.S. state where you live, such as California, Colorado, Connecticut, Virginia, Texas, or Oregon, you may have some or all of these rights regarding your personal information:
- Know and access: confirm whether we process your personal information and obtain a copy of it.
- Correct: correct inaccurate personal information.
- Delete: request deletion of personal information we hold about you.
- Portability: receive your personal information in a portable format.
- Opt out: opt out of targeted advertising, the “sale” or “sharing” of your personal information, and certain profiling.
- Limit sensitive data: limit our use of sensitive personal information, including health information, or withdraw consent where we rely on it.
- Appeal: appeal our decision on your request.
How to exercise your rights. Email admin@biofusion.co with the subject line “Privacy Request” and tell us which right you wish to exercise. We will verify your identity before responding, which may require you to confirm information we already hold. You may use an authorized agent where the law allows, and we may ask for proof of the agent’s authority. If we deny your request, you may appeal by replying to our decision with the subject line “Privacy Request Appeal.”
Non-discrimination. We will not discriminate against you for exercising your privacy rights.
These rights are subject to exceptions under applicable law, and they do not apply to PHI we process on behalf of covered entities, which is governed by HIPAA.
Other sites and services
This Privacy Policy does not apply to third-party websites, applications, products, or services, even if they link to the Service or we refer you to them. Links and integrations are not an endorsement of, or a representation that we are affiliated with, any third party. We do not control third-party services and are not responsible for their practices, so please review their privacy policies.
Security
We use technical, organizational, and physical safeguards designed to protect the personal information we collect. However, no internet or information technology is completely secure, and we cannot guarantee the security of your personal information.
Data location
Biofusion is based in the United States, and the Service is intended for users in the United States. We store and process personal information in the United States.
Retention
We retain personal information for as long as needed to fulfill the purposes for which we collected it, including to satisfy legal, accounting, or reporting requirements, to establish or defend legal claims, and to prevent fraud. To set retention periods, we consider the length of our relationship with you; the amount, nature, and sensitivity of the information; the risk of harm from unauthorized use or disclosure; whether we can achieve our purposes by other means; and applicable legal requirements. For example, we retain your information for as long as you have an account or use the Service, and for a period afterward in which we may reasonably need it. When we no longer need personal information, we delete it, de-identify or anonymize it, or isolate it from further processing.
Children
The Service is not intended for anyone under 18 years of age. If you are a parent or guardian and believe we have collected personal information from a minor in a manner prohibited by law, please contact us at admin@biofusion.co. If we learn that we have collected such information, we will delete it as required by applicable law.
Changes to this Privacy Policy
The “Last Updated” date at the top of this Privacy Policy shows when it was last revised. We may modify this Privacy Policy at any time. If we make material changes, we will update that date and post the revised policy on the Service, or notify you by other appropriate means. Changes take effect when posted unless we state otherwise. Your continued use of the Service after the effective date means the revised Privacy Policy applies to your interactions with us.
